Oracle Senior Legal Counsel in VIENNA, Austria

Job Description

Reporting to the VP for Eastern and Central Europe (ECE) you are responsible and/or assist in the following matters concerning particularly for Serbia, Croatia, Slovenia, Bosnia-Herzegovina and Montenegro:

  • You localize agreements and review translations (with a focus on software licensing, cloud services, maintenance, consulting and hardware contracts) and draft agreements;

  • You provide legal advice related to sales transactions for software, hardware, cloud, consulting and/or other related IT services to both public and private sector, with analysis of relevant laws, risks and potential impact for Oracle and participate in negotiations of agreements with customers and/or customers’ legal counsel(s);

  • You support all internal stakeholders on a continuous basis with all issues which are in the field of Legal with a focus on commercial transactions for software and hardware, cloud, consulting and/or other related IT services, but also concerning procurement, marketing or human resources, while ensuring compliance with law and Oracle’s global business practices, policies and procedures;

  • You assist in the handling of claims, settlement and litigation and co-ordinate with external counsel (where applicable);

  • You assist in corporate household and M&A matters;

  • You assume corporate representative roles, as required;

  • You provide support to Oracle`s Compliance & Ethics team on training and investigations;

  • You provide training on legal issues to Oracle’s internal stakeholders;

  • You perform all other tasks, including administrative tasks, that are appropriate for and required by an in-house company lawyer;

  • You assist in legal matters for other countries in the region of Central and Eastern Europe as need may be.

  • Your profile:

  • You have a law degree from a university in Serbia, Croatia or another country (in such case however coupled with knowledge and experience in Serbian and/or Croatian law) with a focus on Civil Law (Contract Law) preferably with optional courses in IP, IT and/or Public Procurement;

  • Minimum of eight (8) years previous work experience as a lawyer; practical experience from the IT industry and/or experience with public procurement is preferred;

  • Fluency in English as well as Croatian/Serbian/Bosnian (including Cyrillic script) is a must; the knowledge of Slovenian is a benefit;

  • Legal drafting skills in the above languages;

  • Effective verbal and written communication skills is a must (particularly negotiation skills);

  • Business awareness and orientation (capability to match legal expertise to commercial business context);

  • Strong interpersonal skills;

  • Independent and able to make decisions;

  • Analytical thinking (solution driven);

  • Ability to perform under pressure;

  • Comfortable in a complex and changing business environment;

  • Computer skills in Word, Excel and PowerPoint;

  • Drivers License.

Responsibilities

Responsible for providing legal advice to the organization. Close liaison to business in providing a variety of corporate and commercial legal services. May perform litigation on Oracle's behalf or coordinates litigation and other legal, administrative or investigative actions handled by outside counsel. May draft, review, and negotiate major and/or non-standard technology contracts with public and private sector customers, including licensing agreements, professional services agreements, and cloud services agreements. May advise on legal issues involving government and regulatory compliance. Responds to ad hoc queries to include identification, analysis, and evaluation of risks in order to provide appropriate legal solutions. Works closely with other lawyers throughout Oracle and coordinates legal matters handled by outside lawyers. Demonstrates deep general commercial or functional knowledge across a wide range of sub disciplines within the individual's specialty area(s), (e.g., general corporate law, antitrust/competition law, securities compliance and regulatory, employment law, immigration law, cloud transactions, data privacy, risk management asset-backed financing, contract management, intellectual property, trade secrets, advertising law, registration and other resolutions specific to the computer and technology industry)
