Lilly is seeking an attorney with advertising law experience, preferably in the life sciences industry, to support Lilly’s centralized commercial and consumer operations, as we seek to modernize the way we interact with patients and HCP customers in an increasingly digital world. This attorney will work closely with the Associate Vice-President, Assistant General Counsel Commercial/Consumer Operations to support the Lilly Digital Greenhouse Project. The Lilly Digital Greenhouse team was formed in Q1 2023 by the CEO with a clear mandate to advance a digital revolution in pharmaceutical engagement to change the game and reimagine the traditional commercial model. The Lilly Digital Greenhouse team believes that healthcare engagement processes that once frustratingly took months to navigate can be disrupted and simplified to curate an elegant digital experience that improves the patient journey from uncertainty to hope in a single day.

This role requires an attorney with significant experience working with marketing and advertising teams and media arrangements, in both traditional advertising channel and innovative digital spaces. This attorney should have legal expertise in applicable law pertaining to marketing, advertising, and branding. This attorney will need to counsel the teams on various legal matters including, but not limited to, FDA labeling and advertising requirements, the Anti-kickback Statute and its safe harbors, the False Claims Act, antitrust law, unfair competition law, consumer protection, data rights and privacy, FTC Regulations and Guidelines, marketing and advertising law, commercial law, and business transactions.

The attorney will work with a team of cross-functional partners from Lilly Legal, regulatory, medical and marketing to advance Digital Greenhouse goals and objectives. To accomplish this, it is necessary for the attorney to develop collegial and mutually productive relationships across Lilly components. Further, the attorney should develop an expertise over time in FDA promotional regulations and counseling the US teams on the application of those regulations to their decisions. The position will report to the Associate Vice-President, Assistant General Counsel Commercial/Consumer Operations.

Specific activities may include the following:

  • Working with Lilly Legal colleagues and cross-functional partners in supporting Lilly USA’s commercial operations and consumer organizations.

  • Working with 3rd parties as part of a digital ecosystem buildout.

  • Serving as day-to-day strategic business and legal advisor to the Digital Greenhouse team, including support of the following:

  • Design and implementation of digital only commercialization strategies for selected brands within Lilly USA

  • Reviewing various materials, contracts and tactics to ensure compliance with all applicable regulations, internal policies and internal quality systems

  • High quality, timely and decisive legal advice (with appropriate consultation with other subject matter experts) to allow business partners to make well-informed decisions

  • Coordinating with privacy and data security teams to ensure compliance with internal policies as well as evolving external laws and regulations

  • Coordinating with copyright, trademark and IP counsel to ensure appropriate and consistent application of legal requirements

  • Active contribution in making recommendations regarding proposed business activity plans

  • Development of policies, procedures and playbooks to formalize enterprise guidance for new replicable activities.

Basic Qualifications:

  • Juris Doctor degree from accredited school

  • Current license to practice law in at least one of the fifty states; eligible to be admitted to the bar in Indiana

  • A minimum of 5 years of relevant legal experience either practicing as a member of a law firm or government agency in a relevant area of law, in house at a pharmaceutical or biotechnology company’s law department, or a combination

Additional Skills/Preferences:

  • Expertise in media law or experience counseling in the advertising, digital and social media arena

  • Experience counseling in eCommerce space, advertising in new digital channels, or virtual care initiatives

  • Day-to-day experience negotiating and drafting commercial agreements, preferably in the area of media sales and promotion/marketing relationships

  • Experience counseling on new digital capabilities, digital health, utilization of AI or machine learning, or other constantly evolving areas of law

  • Experience working with sophisticated parties in the media and advertising space, in particular, counseling on consumer marketing activities

  • Practical experience with digital technology, social media, and streaming products

  • Industry-related experience and knowledge of FDA regulations and practices across Review Divisions and OPDP (CFR guidelines, FDAMA, Guidances, etc.) and awareness of evolving regulatory reform initiatives

  • Familiarity with data analytics and business intelligence processes

  • Familiarity with privacy, data protection and consumer protection laws

  • Demonstrated ability to advise on complex commercial agreements

  • Start up mentality and willingness to challenge the status quo

  • Strong organizational skills and ability to manage multiple priorities in a fast-paced and evolving environment

  • Strong analytical skills and ability to craft innovation solutions to complex issues, focusing on simplicity and practicality

Additional Information :

  • Some travel required (US and limited international).

  • Lilly currently anticipates that the base salary for this position could range from between $168,000 to $246,400 and will depend, in part, on the successful candidate’s qualifications for the role, including education and experience. Full-time equivalent employees also will be eligible for a company bonus (depending, in part, on company and individual performance). In addition, Lilly offers a comprehensive benefit program to eligible employees, including eligibility to participate in a company-sponsored 401(k); pension; vacation benefits; eligibility for medical, dental, vision and prescription drug benefits; flexible benefits (e.g., healthcare and/or dependent day care flexible spending accounts); life insurance and death benefits; certain time off and leave of absence benefits; and well-being benefits (e.g., employee assistance program, fitness benefits, and employee clubs and activities).Of course, the compensation described above is subject to change and could be higher or lower than the range described above.
