Fluency in German or French and fluency in written and spoken English is required.

Job Description

  • Responsibilities and Accountabilities The Grid Contract Manager Leader for ERCIS-Germany, under the direction of the Grid Contract Management Leader, has overall responsibility for the leadership and management of the ERCIS-Germany Sub-Region Grid Contract Management team and the contract management support and process and procedures development and execution on contractual, change order, and claim activities. Purpose of the Job

  • Lead the ERCIS Germany Sub-Region Contract Management team in its support of the Grid ACS business by identifying and mitigating risk and resolving claims and disputes to reduce margin erosion.

  • Work with the ERCIS Grid business leaders strategizing about business pipeline support and project delivery methods to achieve successful project execution.

  • Establish and ensure effective execution of Contract Management key performance indicators, including, but not limited to effective change order management, insurance recovery and claims and dispute resolution.

  • Collaborate with other key stakeholders on effective cross-functional expertise.

  • Work with Sourcing on vendor recovery issues and reducing margin erosion is subcontractor and supplier contracts based on inclusion of necessary flow-down terms and conditions.

  • Provide systematic and efficient analysis of contractual requirements and management of the execution of such contracts made with customers, partners, contractors, subcontractors and suppliers for the purpose of maximizing financial and operational performance and minimizing risks.

  • Establish and implement project specific commercial procedures particularly regarding claims, insurance, correspondence and notification.

  • Lead team in ensuring GE’s rights and entitlements are protected and acted upon as provided in the Contract.

  • Ensure team appreciates and implements necessary PM safeguards to create and maintain satisfactory project documentation (including notices) to substantiate claims and disputes.

  • Manage claims to / from customers and consortium partners.

  • Support and provide guidance to Project Team on general contractual issues. Main Duties

  • Collaborate with Legal, Sourcing, and Quality regarding contract management and best practices for process development.

  • Work with team to ensure processes followed regarding pass-through terms and conditions for subcontracts and supplier purchase orders.

  • Support the project execution start-up, prior to full Notice to Proceed, including Contract analysis and preparation of Project Contract Commercial Plan.

  • Assume responsibility for all project contractual activities from hand over from Sales/Commercial until all relevant contractual obligations are complete, including financial reconciliation, and all relevant contractual issues are resolved/ settled.

  • Lead team in the identification of Customer/Consortium and other third-party obligations and development and implementation of the Project Contract Commercial Plan, including Project Claim Strategy.

  • Liaise with the Project Director regarding commercial strategy development and execution to ensure that the contract schedule is met and appropriate schedules for subcontracts are produced and maintained, to support Project Claim Strategy.

  • Support project risk and opportunity identification and analysis. Support the management of risks and opportunities by development and implementation of appropriate Project Contract Commercial Plan.

  • Ensure adequate processes and procedures to ensure the preservation of Grid’s rights and entitlements as provided in the contract. Ensure proper notices are given in line with contract requirements. Management of claims to/from customers and consortium partners. Support the management of claims to/from subcontractors and suppliers as required.

  • Ensuring appropriate recovery from third parties. Lead mitigation strategy development and negotiations on complex, multi-million dollar claims with customers, subcontractors, and consortium partners. Ensure appropriate documentation executed, including Settlement Agreements.

  • Lead team in developing strategies for the management of customer change orders and other margin enhancement initiatives.

  • Establishment and implementation of project specification contractual procedures, particularly regarding claims, insurance, variation orders, correspondence and notifications.

  • Support and guide the Project Management team in general contractual issues. Clarification of contractual/legal queries, if required by referring to Legal. Qualifications: Educational Qualification Requirements

  • University Degree in Engineering, Construction and Project Management, Business Administration or Law.

  • Contract and claim experience in large EPC projects (min 10 years).

  • Preferred experience in Site Construction issues in the power/energy industry.

  • Proven track record in leading a team Experience and Knowledge

  • Ability to communicate with multiple levels of Grid management in matrix organization

  • Strong and proven ability to multi-task and pivot

  • Understanding of Contract law

  • Technical understanding of project management and execution

  • Excellent writing skills

  • Experience of high-level negotiations
