The Compliance Specialist plays a crucial role in ensuring adherence to equal opportunity programs and compliance standards within the Office of Equal Opportunity and Compliance Programs (EOCP). The primary responsibility involves overseeing compliance, reporting, and management of approximately 180 to 220 Minority/Disadvantaged Business Enterprise (MBE/DBE) open procurement contracts. This includes analyzing and interpreting MBE/DBE procedures, assisting in establishing participation goals, reviewing waiver requests, and monitoring contracts for compliance with state and federal regulations.

Responsibilities:

  • Evaluate MBE/DBE procedures to ensure adherence to state and federal guidelines, demonstrating meticulous attention to detail and accuracy.

  • Collaborate with stakeholders to establish clear and achievable MBE/DBE participation goals aligned with organizational objectives.

  • Review MBE/DBE waiver requests for compliance with State and Federal guidelines, ensuring thoroughness and accuracy in the review process.

  • Monitor contracts for MBE compliance with COMAR and Federal USDOT regulations, conducting regular audits to ensure adherence to standards.

  • Investigate MBE/DBE complaints, conduct thorough inquiries, and maintain detailed records of findings and resolutions.

  • Perform desk audits and field visits to verify compliance with MBE/DBE requirements, documenting observations and recommending corrective actions as needed.

  • Effectively communicate non-compliance findings or MBE-related issues to the Chief EOC Officer, preparing clear and concise correspondence to address non-compliance issues.

  • Generate reports using FMIS/IFMIS to assist in the preparation of monthly MBE/DBE payment reports.

  • Prepare Federal and State MBE/DBE procurement reports as needed, ensuring accuracy and timeliness in reporting processe

  • Act as a liaison, attending various meetings with Procurement Review Groups (PRG) and Pre-Bid/Construction teams to discuss compliance requirements and provide guidance as necessary.

  • Assist with planning, coordinating, and executing community outreach efforts of the MBE/DBE program, fostering positive relationships with external stakeholders.

  • Provide administrative support to the Chief, Equal Opportunity Compliance Programs as assigned, demonstrating proficiency in office management and organizational tasks.

  • Train, assign work, and inspect work to ensure compliance with laws, codes, standards, or policies.

  • Issue findings of compliance or non-compliance based on the review of prime contractor's MBE/DBE commitment.

  • Gather data for MTA Procurement office to determine MBE/DBE compliance activity on contracts.

  • Resolve disputes between prime and subcontractors regarding non-payment issues.

The Compliance Specialist serves as the MBE/DBE Compliance Officer, overseeing contract compliance, reporting, and management. This role is critical to EOCP and involves a wide range of responsibilities, including executive-level administrative support to all areas of the department.

Qualifications

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Three years experience in administrative or professional work. One (1) year of the required experience must have been in monitoring Minority/Disadvantaged Business Enterprise (MBE/DBE) participation on contracts. *One (1) year of the required experience must have been in accounting or finance, including financial reporting or equivalent experience in procurement and contract management activities.

  • A Selective qualification recruitment is conducted for positions when there is a specific or additional bona fide occupational qualification (i.e., knowledge, skill, or ability).

Notes:

  1. Candidates may substitute education at an accredited college or university at the rate of 30 credit hours for each year of the required experience.

  2. Candidates may substitute the possession of a Bachelor's degree from a college or university for the required experience.

  3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work that included regular use of independent judgment and analysis in applying and interpreting complex administrative plans, policies, rules or regulations, or analysis of operational programs or procedures with recommendations for improvement on a year-for-year basis for the required experience.

Employees in this classification may be assigned duties that require operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the state of Maryland.
