TEXAS RACING COMMISSION Administrative Law Judge in Austin, Texas

Performs highly complex (senior-level) administrative hearing duties involving violations of the Texas Racing Act and the Texas Rules of Racing. Case work includes occupational licensing, drug testing and may include alternative dispute resolution proceedings. Works under limited supervision with considerable latitude for initiative and independent judgment. Travel is required.

ESSENTIAL DUTIES:

  • Conducts hearings involving legal, procedural, and technical issues.
  • Schedule and presides over hearings.
  • Administers oaths, examines witnesses, and rules on evidence.
  • Interpret and enforce the Texas Racing Act and Commission rules and determine all questions, disputes, complaints, or objections relating to racing matters in accordance with applicable laws.
  • Conduct adjudicatory hearings and impose penalties for unethical practices or violations of racing rules, consistent with commission policy and guidelines.
  • Directs and plans the agencys legal activities.
  • Provides assistance in the preparation, development, and review of legislation and may testify at hearings and legislative meetings as needed.

KNOWLEDGE, SKILLS, AND ABILITIES:

  • General knowledge of administrative procedure as it relates to the conduct of agency and appellate hearings.
  • Knowledge of trial and administrative hearing procedures, applicable laws, government regulations, and agency rules.
  • Skill in listening to testimony of parties involved in hearings; in using reasoning and logic to identify solutions and approaches to cases; in using judgment to make rulings in assigned cases; and in the use of a computer and applicable software.
  • Ability to determine and apply relevant rules and statutes; to comply with ethical standards; to recognize problems and identify and facilitate solutions; to communicate effectively; and to supervise the work of others.

MINIMUM EDUCATION AND EXPERIENCE:

  • Graduation from an accredited law school with an L.L.B. or J.D. degree.
  • Member in good standing with the State Bar of Texas.
  • At least five (5) years progressively responsible experience in administrative law and three (3) years experience in administrative rule-making procedures or senior legislative experience with a state agency and/or a statewide elected official preferred.
  • Two (2) years of experience as a manager, supervisor, or team leader in a legal or legislativesetting preferred.
  • Completion of leadership or management training such as programs from the Governor's Center for Management Development, including the Management Development Program, the Governor's Executive Development Program preferred.
  • Must possess a valid class C driver's license, proof of auto liability insurance, and an acceptable driving record from the Department of Public Safety.
