Minimum Qualifications Preferred Qualifications: Admission to the New York State Bar and a member in good standing with at least 3 years post NYS Bar admittance legal experience as a practicing attorney. The preferred candidate must have strong legal skills, be able to adhere to strict deadlines, have demonstrated ethical and intuitive decision-making, have a working familiarity with public health issues, be able to work as a member of a leadership team, good supervisory and management skills and possess excellent oral and written communication skills, and should have the ability to manage a varied and demanding caseload and meet regular deadlines. The preferred candidate will have experience with Medicaid rules and regulations, with a working knowledge of Home and Community Based Services rules and regulations; a working knowledge of the Mental Hygiene Law and the Public Health law; experience working with property issues, including bond issues; estate and guardianship issues; and contracting and procurement law. The preferred candidate should possess working knowledge of Microsoft Suite, Adobe, Excel and Westlaw. Notaries are also preferred.

Duties Description The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on the myriad of issues arising from the delivery of supports and services to individuals with intellectual and developmental disabilities (IDD). Attorneys are called upon to draft and review legislation, regulations, contracts, and real property transactions, provide advice on federal and State health care delivery and funding, advise on employment matters, participate in administrative hearings and oversee litigation. The Associate Counsel will head the Medicaid, Contracts, and Real Estate Bureau within OPWDD Counsel's Office. The candidate will be part of the Office of Counsel leadership team and will interact with the Commissioners' office and the Executive Leadership team to provide legal advice and recommendations. The candidate may also interact with Executive Chamber to provide information and advice on issues before the agency. Reporting to the General Counsel, the Associate Counsel supervises attorneys and other professionals assigned to the Bureau and oversees the provision of legal advice and supports in the areas of: ·Medicaid State plan and Home and Community Based Services (HCBS) waiver programs; ·Medicaid managed care programs;·Medicaid audits;·Procurement, contracting, and interagency agreements;·Funding and financing of services and housing for persons with intellectual and developmental disabilities;·Real estate occupied, leased or funded by OPWDD, including sales of property, leases and property disputes;·Site selection; and·Monies and assets held by or for individuals receiving OPWDD services, including matters involving Medicaid exception trusts.
